Entrant further agrees to release Sponsor from any and all claims that any such use by Sponsor, including any commercial advertising presentation, web content or any other material subsequently produced, presented and/or prepared by or on behalf of Sponsor , infringes Entrant's rights with regard to any Elements, characters or ideas contained in its Entry. LIMIT ONE ENTRY PER REGISTERED ENTRANT. You may enter the contest under one name and one e-mail address only. Enter using only a YouTube® account subscribed to and registered in your name. In the event of a dispute about entries submitted by multiple individuals using the same YouTube® account, entry will be deemed to have been submitted by the authorized subscriber of the YouTube® account used to enter the contest at the actual time of entry. The authorized YouTube® account subscriber is deemed to be the natural person who is assigned a YouTube® account by YouTube®. Each video must be submitted by the individual pictured and heard in the video and whose name appears as the Entrant on the YouTube® account. The video may feature an individual other than the Registered Entrant if the Registered Entrant has obtained permission from each person who appears in the video, and can make such permission available to Sponsor upon request. However, if such video is selected as a winning entry, only the Registered Entrant will receive the prize.
  5. WHAT CAN I WIN? One (1) Grand Prize. Ten (10) First Prize winners will each receive a $100 Barnes and Noble® gift card. See back of the gift card for full terms and conditions of use. Any product or service purchased may be warranted or covered by the Barnes and Noble® satisfaction and return policies, and Sponsor has no liability for disputes between winner and Barnes and Noble®. Prizes will be mailed to the winners on or before October 31, 2008. Total prize value: $6,000. Winners and/or winners' parents or legal guardians in the event winner is a minor under the laws of winner's state of residence are responsible for the reporting and payment of all federal, state and local taxes incurred by the acceptance of the prize. Prizes cannot be assigned, transferred, exchanged or otherwise redeemed. Sponsor is not responsible for any costs associated with accepting or otherwise using the prize. Acceptance of prize constitutes permission to the Sponsor and its agents to use winner's name, likeness, and video for purposes of advertising and trade without further compensation, unless prohibited by law.
  6. HOW DO I WIN? Potential prize winners will be chosen by a panel of judges who are also Peterson's employees on or about August 1 to August 15, 2008, from among all entries received. Videos will be judged on the criteria set forth in paragraph 7 below. Judges' decisions are final, binding and conclusive on all matters related to the Contest. Odds of winning will depend upon the total number of eligible entries received and the required criteria points.
Three attempts to contact the potential Prize winners by means of their YouTube® accounts will be made. If the potential Prize winner is unable to be reached within five (5) days of the third contact attempt, or refuses to accept the prize, the potential winner will be disqualified and an alternate winner will be selected. If receipt of the prize is restricted by law or employment policy applicable to the potential winner or potential winner's family (parents, children, siblings and spouse) and member of the households (whether or not related) of each, the potential winner will be disqualified and another winner selected. In the event the potential winner is a minor, the prize may be awarded in the name of his/her parent or legal guardian who shall be responsible for fulfilling all requirements imposed on the winner in these Official Rules.
Potential prize winners (and/or their parent or legal guardian if such winner is a minor) must sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Prize Documents") within 14 days of receipt of Prize Documents. Sponsor shall have no liability or responsibility to award any prize where: (a) any required Prize Documents are not fully executed and received by Sponsor at the designated address by the due date specified in Prize Documents; or (b) if any mail addressed to the potential Winner is returned to Sponsor as undeliverable without a forwarding address or if potential Winner cannot be contacted for any reason; or (c) potential Winner is deemed ineligible or otherwise non-compliant with any aspect of these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH INDIVIDUAL'S DISQUALIFICATION AS A WINNER AND ALL PRIVILEGES DUE SUCH INDIVIDUAL WILL BE IMMEDIATELY TERMINATED AND ALTERNATE PRIZE WINNER WILL BE SELECTED. Potential winners may be subject to a background check, which must be satisfactory in Sponsor's absolute discretion. In the event the potential winner is ineligible to participate based upon the information contained in the background check, an alternate winner will be selected.
  7. JUDGING CRITERIA. Judges will select prize winners based on the following criteria: creativity and originality (40%), passion and enthusiasm about education (30%), presence/mention of Peterson's (10%) and overall impression (20%). The entry with highest overall score will be declared the potential contest grand prize winner (in the event of a tie, the entry with the higher score in the creativity and originality criteria will prevail). All decisions of the judges are final.
